Terms of Service

Kwek2 Basketball

Effective Date: November 15, 2025

By accessing or using Kwek2 Basketball (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old or have verifiable parental consent to use the Service. Users aged 13–17 may only use the Service with permission from a parent or legal guardian.

2. Account Registration

You must create an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3. User Content – Videos You Upload

3.1 Permitted uploads

You may only upload videos that:

• You personally recorded
• Feature only your own basketball performance (or performances in which every participant has given explicit consent)
• You own all rights to or have all necessary permissions/licenses for

3.2 Prohibited uploads

Prohibited uploads include, but are not limited to:

• Professional, college, or broadcast NBA/NCAA footage
• Videos of other people without their consent
• Any third-party copyrighted material
• Illegal, obscene, threatening, or harmful content

3.3 You represent and warrant that every upload complies with Section 3. Violation will result in immediate account termination, deletion of content, and permanent ban, with no refund.

4. License You Grant Us

By uploading a video, you grant Kwek2 Basketball a worldwide, royalty-free, perpetual, irrevocable license to:

• Process, analyze, store, and create derivative works (statistics, highlights, anonymized training data)
• Use anonymized portions to train and improve our AI models

5. Processing Time & Results

5.1 Video analysis typically takes 1–7 days depending on length, queue, and complexity. We make no guarantee of turnaround time.

5.2 Results (shots, rebounds, etc.) are estimates provided “as-is.” We do not warrant accuracy, completeness, or fitness for any purpose. You may not rely on results for medical, coaching certification, or scouting decisions.

6. Payments & Subscriptions

6.1 Subscriptions are billed monthly or annually in advance and auto-renew until cancelled.

6.2 Cancellation takes effect at the end of the current billing period. No prorated or partial refunds.

6.3 We may change pricing with 30 days’ notice. Continued use after the change constitutes acceptance.

7. Prohibited Conduct

You may not:

• Upload excessive videos to overload the system
• Attempt to reverse-engineer, extract training data, or bypass limits
• Use the Service for commercial purposes without written permission
• Share your account or results in a way that violates these Terms

8. Termination

We may suspend or terminate your account immediately, with or without notice and with or without refund, for any reason, including but not limited to suspected violation of these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS-IS” AND “AS-AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ACCURACY OF STATISTICS, UPTIME, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWEK2 BASKETBALL’S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PREVIOUS 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Kwek2 Basketball, its affiliates, and personnel from any claims, losses, or damages arising from your uploads or violation of these Terms.

12. Changes to Terms

We may update these Terms at any time. We will notify you by email or in-app notice. Continued use after the effective date of changes constitutes acceptance.
